Notice Requirements - Claims against a Public Entity
New Jersey Statute § 59:8-4
A notice of claim must include the following information:
- The plaintiff’s name and mailing address;
- The date, time and location where the injury occurred;
- A brief description of how the incident occurred and what injuries were suffered;
- The name of the public entity responsible for the injuries; and
- The amount and type of claim being filed, including the amount of damages the plaintiff seeks to recover.
the State Attorney General or to the public entity responsible for the injury within ninety days from the date the injury occurred.
Waiting period after notice
A person must wait six months after filing a Notice of Claim to file a lawsuit. Such a lawsuit must also be filed within two years from the date of injury.
