Eviction
N.J.S. 2A: 18-53: Removal of tenants in certain cases; jurisdiction
Eviction is the legal procedure to force a tenant to leave the premises. A landlord must lave a legal reason for eviction, such as the tenant not paying rent or violating other lease terms.
In New Jersey any non-residential tenant or subtenant can be evicted for one of these reasons:
- Staying after the lease has ended and the landlord has notified the tenant in writing to leave;
- Staying after failing to pay rent;
- Being disorderly and disrupting other tenants or neighbors;
- Intentionally destroying the property;
- Consistently violating the landlord’s rules and regulations that were part of the lease; or
- Violating any other part of the lease that specifically gave the landlord the right to evict.
The landlord must give the tenant written notice that the lease has been terminated. The tenant must leave within three days.
