Tenant's Obligations under Lease


When a lease is signed between a landlord and a tenant, the tenant has certain legal obligations to the landlord. The tenant must:

  • Pay rent;
  • Not damage the premises;
  • Not use the premises for illegal purposes; and
  • Not disturb other tenants.
Duty to pay rent
The tenant's primary obligation under the lease agreement is to pay the landlord as agreed for the use and enjoyment of the property.

Duty not to damage the premises
At the end of the lease, the tenant must return the premises to the landlord in good condition. Generally the tenant must:

  • Make reasonable and ordinary repairs to keep the property in good shape, allowing for reasonable wear and tear;
  • Keep the premises reasonably clean and free of garbage, waste and rubbish;
  • Not deliberately or negligently destroy, deface, damage or remove any parts of the premises;
  • Do whatever is required of tenants by any building or housing codes.
Duty not to use the premises for any illegal purposes
The tenant cannot use the premises for any illegal activity, such as gambling, prostitution or drug possession or use.

Duty not to disturb other tenants
The tenant must not disturb the other tenants or create a nuisance.


If a tenant does not meet these obligations, the landlord may be able to evict the tenant.
