Premises Liability - At A Glance
Premises Liability is the area of law that covers injuries caused by problems or defects associated with someone else's property. Premises Liability cases include slip and fall accidents due to faulty construction or improper maintenance, dog bites, and assaults.
A person can be found at fault for premises liability where there is proof that the person:
- Had notice of the condition or situation; and
- Was in control of the property where the injury occurred.
A lawsuit can be successful if an injured party satisfies the two requirements above and proves that the injuries were somehow related to a problem or defect associated with property.
