New Jersey Statute ยง 2A:31-3 - Limitation of Actions
The Wrongful Death Statute requires that a lawsuit must be brought within a specified period of time known as the Statute of Limitations.
The Statute of Limitations for wrongful death actions in New Jersey is two years from the date of death. This means that the estate or guardian of a person who was wrongfully or negligent killed must file a lawsuit for wrongful death within two years of the date of death. For example, if a person died on January 1, 2000, a lawsuit would have to be filed by December 31, 2001.
