2nd Child Sex Charge For Man A man already arrested for possession of child pornography is facing new charges involving a 12-year-old boy.

Phillip Neary, 40, is accused of luring the boy using the Internet to an alleged attempted sexual assault in New Jersey.

Neary was arrested in April 2004 for possessing child pornography. Just four months later, he is back behind bars for allegedly trying to fly a 12-year-old boy from California to New Jersey for sex, police said.

"Mr. Neary was arrested (Monday) and he was charged with luring a minor via the Internet, attempted aggravated assault and endangering the welfare of a child. Two search warrants were simultaneously executed at Maple Shade Township, Burlington County, N.J., and Pittsgrove Township, Salem County, N.J.," said Detective Stanley Field, of the New Jersey State Police.

Computer equipment was taken from both places, but state police arrested Neary in Maple Shade.

Investigators believed he was on his way to the airport to meet the boy he communicated with on the Internet.

"The accused's intention was to have a 12-year-old temporarily reside with him with the purpose of having sexual relations," Field said.

Neary's arrest for the second time in four months follows a joint investigation by San Jose, Calif., police and the National Internet Crimes Against Children task force.

"Without the cooperation of these task forces, these type of crimes could not be investigated and these type of individuals could not be arrested," said Detective Sgt. Gordon San Martino, of the New Jersey State Police.

The task force notified New Jersey State Police.

"Detectives posing as a 12-year-old male living with a foster family met the accused in a chat room, via the Internet. The chat had heavy sexual overtones where the accused debauched the morals of a 12-year-old," Field said.

Neary's bond was set at $100,000. He has requested a court-appointed attorney.
