Refusal to Submit to Breathalyzer Test
New Jersey Statute: 39:4-50.4a. (Revocation for refusal to submit to breath test; penalties)
If a driver:
- is arrested for drunk driving and
- refuses to take a breath test when asked to do so by a police officer
-that person may be guilty of refusal to submit to a breath test.
Penalties:
If the driver is found guilty:
First Offense:
- A fine of $250 to $500 and
- Loss of driver’s license for 6 months.
Second Offense:
- A fine of $250 to $500 and
- Loss of driver’s license for 2 years.
Third or More Offenses:
- A fine of $250 to $500 and
- Loss of driver’s license for 10 years.
If the driver is:
