Driving While License is Suspended or Revoked
New Jersey Statute: 39:3-40 (Driving when license refused, suspended, revoked or prohibited)


If a driver operates any motor vehicle while their license is properly suspended or revoked, that driver may be guilty of Driving While License is Suspended.


Penalties:
If the driver is found guilty:
And no one was injured, then:
First Offense:

  • A fine of $500; and
  • Loss of driver’s license for up to an additional 6 months.
Second Offense:
  • A fine of $750;
  • A jail sentence of up to 5 days; and
  • Loss of driver’s license for up to an additional 6 months.
Third Offense:
  • A fine of $1,000;
  • A jail sentence of up to 10 days; and
  • Loss of driver’s license for up to an additional 6 months.
If someone was injured, then:
  • A sentence of 45 days in jail.
If a driver was also drunk while driving with a suspended license:
  • A fine of $500;
  • A jail sentence of up to 90 days; and
  • Loss of driver’s license for an additional 1 to 2 years.

  • No points
  • Being found guilty of this offense carries an automatic suspension of a driver’s license.
