Drunk Driving
New Jersey Statute: 39:4-50 (Driving While Intoxicated)
If a driver:
- drives a vehicle while drunk or under the influence of any habit producing drug; or
- the level of alcohol in the driver’s blood is .10% or more; or
- if a person lets someone else who is drunk or has a blood alcohol level of .10% or more drive a vehicle whether or not the person actually owns the vehicle;
- that driver may be guilty of drunk driving
Penalties:
If the driver is found guilty:
First Offense:
- A fine of $250 to $400
- A Drunk Driving Enforcement Fund surcharge of $100
- A Safe Neighborhood Services Fund surcharge of $75
- Required attendance at a program set up by the Intoxicated Driver Resource Center
- A jail sentence of up to 30 days
- Loss of driver’s license for 6 months to 1 year
- An insurance surcharge on their car insurance.
Second Offense:
- A fine of $500 to $1,000 and
- A Drunk Driving Enforcement Fund surcharge of $100
- A Safe Neighborhood Services Fund surcharge of $75
- 30 days of community service
- A jail sentence of 2 to 90 days
- Loss of driver’s license for 2 years, with the necessity of applying for it to be reinstated at the end of that period
- An insurance surcharge on their car insurance.
Third or More Offenses:
- A fine of $1,000
- A Drunk Driving Enforcement Fund surcharge of $100
- A Safe Neighborhood Services Fund surcharge of $75
- A jail sentence of up to 180 days, though at the court’s discretion, 90 days of community service can be substituted for 90 days of the jail sentence
- Loss of driver’s license for 10 years.

- Being found guilty of this offense carries an automatic suspension of a driver’s license.
