Burglary
New Jersey Statutes Annotated 2C:18-2: Burglary


A person is guilty of burglary if, with purpose to commit an offense therein, he:

  • Enters a research facility, structure, or a separately secured or occupied portion thereof;
    • Unless the structure was open to the public at the time or the actor is licensed or privileged to enter; or
  • Surreptitiously remains in a research facility, structure, or a separately secured or occupied portion thereof, knowing that he is not licensed or privileged to do so.


If in the course of committing burglary, the actor:

  • Purposely, knowingly or recklessly inflicts, attempts to inflict or threatens to inflict bodily injury on anyone; or
  • Is armed with or displays what appear to be explosives or a deadly weapon;
It is a crime of the second degree and is punishable by:
  • Imprisonment for five to ten years;
  • A fine of up to $150,000; or
  • Both.

Otherwise, burglary is a crime of the third degree punishable by:
  • Imprisonment for a term of three to five years;
  • A fine of up to $15,000; or
  • Both.
