Manslaughter
New Jersey Statutes Annotated 2C:11-4(a): Manslaughter


Homicide is manslaughter when:

  • It is committed recklessly;
  • It would otherwise be murder, but is committed in the heat of passion resulting from a reasonable provocation; or
  • The actor causes the death of another person while fleeing or attempting to elude a law enforcement officer.


Manslaughter is a crime of the second degree.

  • If the death is caused while trying to escape a police officer, a person may be imprisoned for a term of 5 to 15 years.
