Careless driving
New Jersey Statute: 39:4-97 (Careless Driving)


If a driver operates a vehicle without proper care, and someone is injured or nearly injured, or property is damaged or nearly damaged, the driver may be guilty of careless driving.

A driver must appear in court if they are cited for Careless Driving and there is personal injury.


Penalties:
If the driver is found guilty:

  • A fine of $78
(Note that this can only be done if there are no injuries.)

If the driver is found guilty following a court appearance:

  • A fine of at least $50 to $200; or
  • A jail sentence of up to 15 days; or
  • Both
