Child Car Seats and Seat Belts
New Jersey Statute 39:3-76.2a. (Child passenger restraint system; use; failure to use not contributory negligence; inadmissibility in evidence)


  • All children under (18) years old are required to wear a seat belt or other safety restraint while riding in any motor vehicle in New Jersey.
  • All children under 18 months old must be restrained in a federally approved car seat.
  • All children between 18 months and 5 years old must be:
    • Seated in a car seat or
    • Seatbelted in the rear seat of the motor vehicle.
If the motor vehicle does not have a rear seat, then a car seat must be used for all children under 5 years old. If there are more children in the vehicle than there are seat belts, any children who are not restrained by a car seat or seat belt must sit in the rear seat of the motor vehicle.


Penalties:
A fine of $44, which may be suspended by the Court if the driver can prove that they have a federally approved car seat, and the driver is using it.
