Driving with Drugs in Possession
New Jersey Statute: 39:4-49.1 (Operating Motor Vehicle with Controlled Dangerous Substance or Prescription Drug Legend in Possession or in Motor Vehicle)
If a driver knowingly has any illegal drugs (a controlled dangerous substance or prescription drug) on his or her person or in the vehicle while they are driving, that driver may be guilty of Driving With Drugs in Posession.
A driver must appear in court if cited for this offense.
Penalties:
If the driver is found guilty:
- A fine of $50 and
- Loss of driver’s license for 2 years.

- Being found guilty of this offense carries an automatic suspension of a driver’s license.
