Failure to Stop or Yield
New Jersey Statute 39:4-144 (Stopping or yielding right of way before entering stop or yield intersections)
If a driver:
- Fails to bring the vehicle to a complete stop within 5 feet of the walkway or stop line at any intersection marked with a “stop” sign; or
- Pulls into an intersection from a complete stop when it is unsafe to do so because of oncoming traffic; or
- Enters an intersection marked with a “yield” sign without slowing down or stopping for oncoming traffic
-that driver may be guilty of failure to stop or yield.
Penalties:
If the driver is found guilty:
- A fine of $78; or
- A fine of $133 if the driver receives the ticket in a construction zone or 65 MPH zone.
If the driver is found guilty following a court appearance:
- A fine of $50 to $200; or
- A jail sentence of up to 15 days; or
- Both.
