Leaving the Scene of An Accident
New Jersey Statute: 39:4-129 (Action in case of accident)


If a driver is involved in an accident:

  • That driver must give their name, address, driver’s license and registration to the other driver or a police officer at the scene.
  • The driver must also help to get any necessary medical assistance for any injured person before leaving the accident scene.

If a driver hits a parked vehicle:
  • The driver must try to find the owner or leave a name and address in plain view on the damaged vehicle.
  • The accident must be reported to the police.

If a driver does not perform the actions required by law at the scene of an accident, and/or intentionally leaves an accident scene, that driver may be guilty of Leaving the Scene of an Accident.

Under the law, it is assumed a driver understands he or she was involved in an accident if there are injuries or property damage costing $250 or more.


Penalties:
If the driver is found guilty:
The penalties a driver faces depend upon whether the collision caused any death, injury or property damage, and whether it is the driver’s first or second offense.

If someone was hurt or killed:
First Offense:

  • A fine of $500 to $1,000; or
  • A jail sentence of 180 days; or
  • Both; and
  • Loss of driver’s license for 1 year.
Second Offense:
  • A fine of $1,000 to $2,000; or
  • A jail sentence of 180 days; or
  • Both; and
  • Loss of driver’s license forever.
If there was damage to property:
First Offense:
  • A fine of $200 to $400; or
  • A jail sentence of up to 30 days; or
  • Both; and
  • Loss of driver’s license for 6 months.
Second Offense:
  • A fine of $400 to $600; or
  • A jail sentence of 30 to 90 days; or
  • Both; and
  • Loss of driver’s license for 1 year.
If there was damage to a parked vehicle:
First Time:
  • A fine of $200 to $400; or
  • A jail sentence of up to 30 days; or
  • Both; and
  • Loss of driver’s license for 6 months.
Second Time:
  • A fine of $400 to $600; or
  • A jail sentence of 30 to 90 days; or
  • Both; and
  • Loss of driver’s license for 1 year.


Points:

  • 2 points if no one was injured
  • 8 points if someone was injured
