Improper passing
New Jersey Statute: 39:4-86 (Overtaking and Passing Vehicles; Crossing No Passing Lanes)
If a driver:
- passes another vehicle in front of oncoming traffic;
- passes another vehicle by crossing over a solid or double solid line in the road;
- passes where there is a sign that states “No Passing”
- that driver may be guilty of improper passing
Penalties:
If the driver is found guilty:
- A fine of $78; or
- A fine of $133 if the driver received the ticket in a construction zone or 65 M.P.H. speed zone.
If a driver pleads guilty in Court or the Court finds a driver guilty after trial:
- A fine of $50 to $200; or
- A jail sentence of up to 15 days; or
- Both
