Improper Passing on the Right
New Jersey Statute: 39:4-85 (Passing to Left when overtaking; passing when in lanes; signaling to pass; passing upon right)


To legally pass another vehicle traveling in the same direction as their vehicle, a driver must pass on the left. If a driver passes another vehicle on the right, that driver may be guilty of passing on the right.


Penalties:
If the driver is found guilty:

  • A fine of $78; or
  • A fine of $133 if the driver received the ticket in a construction zone or 65 M.P.H. speed zone.
If a driver pleads guilty in Court, or the Court finds a driver guilty after trial:
  • A fine of $50 to $200; or
  • A jail sentence of up to 15 days; or
  • Both
